Rules vary from town to town, checks need
to be made with your local town hall. They
can just knock on the door and ask to see
your permission, even when you thought you
were doing some minor improvements like
putting in a new kitchen. The laws are not
confined to just the outside of a house.
There are different guidelines in each town
as to what can and cannot be done in the
garden. We all know you need planning
permission to put in a swimming pool but not
everyone knows that you cannot chop down
trees without permission or that some trees
are protected and it will not be allowed.
After carrying out works, there may be a
difference in the size of the property. When
selling the property, the new works must be
incorporated in a new Deed.
Don’t make your property unsaleable by not
getting your paperwork in order. The
likelihood is that you would lose your sale.
Finally, if your property is part of a
Comunidad then there may be additional
requirements. It would be wise to check !

Many expats unwittingly fall foul of the
Spanish regulations when undertaking
alterations to a property and some find
themselves in trouble with local town halls.
No matter how small the job may seem,
you should always check whether the work
apply for permission. If you do intend to
carry out substantial renovation work, such
as an extension, you will certainly need a full
licence. For this, you would also need a
certificate from a registered architect, which
should be presented to the town hall as a
vital part of your application.
The council will grant either a minor works
(obras menor) or major works (obras
mayor) licence and calculate the payment of
appropriate taxes payable on a scale of
improvements. Basically, if you are making
your home more valuable, the local council
want their share.
You should never start any work before
seeking permission - or whilst the process is
still ongoing - you might find if you do, work
will be stopped and permission that would
normally be granted may not! Plus you may
find work completed without permission be
demolished at your expense.
