Gay Civil Partners, Married and
non-married Same sex couples in Spain?
The Costa Blanca has attracted a large community
of gay
residents  many of whom are in established
relationships and run businesses as a partnership
as well as living together. There are also many
retired same sex partners on the Costa Blanca.
Sadly most have not taken proper legal provision to
protect their assets for a partner.

The trouble is that not many people really think
about what would happen if something should
happen to their partner and have taken no action or
incorrect action to legally secure assets in
accordance with Spanish and English law.

In Spain the law is clear.  The legal system applies
“compulsory heirs”  It is historical and is intended to
keep wealth within a family.  The Spanish do not
have a choice about who they leave their assets to.

Is their anything we can do about it?
The simple answer is yes.  You both need an
English and Spanish Will setting out clearly your
wishes.  One  possibility is to use
Usufruct.

Will that be the end of it?
The answer to that is no because there are
inheritance law complications and the tax paid  by
beneficiaries can be high. You need to sort this out
also-

We are civil partners in the UK does this mean we

Sadly not as your estate in Spain will fall under
Spanish law.  Despite legal marriage in Spain and
recognition of civil partners from the UK the laws of
inheritance still apply.  If you do have a Will in
England and in Spain these may possibly contradict
each other which could be a recipe for long drawn
out  legal issues in the future.
